MAKE DESIRE

Portfolio & Creative Work Policy

Effective Date: September 2026

MAKE DESIRE is committed to presenting portfolio material as accurately and transparently as reasonably possible. This policy explains how work displayed on the website is classified, represented and handled, particularly where portfolio material may include client work, original concepts, recreated or exploratory projects, or creative references.

1. PURPOSE AND SCOPE

This policy explains how MAKE DESIRE presents creative and portfolio material on makedesire.my. Its purpose is to help visitors understand the nature of projects shown on the website and to distinguish genuine client work from concepts, experiments, recreations and references.

Portfolio material is presented for demonstration of creative direction, design capability, technical exploration and service capability. The presence of a project on this website should not automatically be interpreted as evidence of a client relationship, commercial engagement, endorsement or ownership of every asset appearing within that project.

2. CLASSIFICATION OF PORTFOLIO MATERIAL

MAKE DESIRE may present portfolio material under different classifications depending on how the work was created and what rights or relationships apply to it.

2.1 CLIENT WORK

Client Work refers to work genuinely created or delivered by MAKE DESIRE for a client or organisation as part of an actual engagement.

Where a project is presented as client work, MAKE DESIRE will aim to describe the project accurately and will not knowingly invent client relationships, project outcomes, testimonials, performance results or other material facts.

2.2 ORIGINAL MAKE DESIRE CONCEPTS

Original MAKE DESIRE Concepts are projects developed by MAKE DESIRE for demonstration, experimentation, creative exploration, portfolio development or internal presentation rather than as commissioned work for a client.

Concept projects may represent hypothetical businesses, products, campaigns, websites, applications or advertising ideas.

A concept project should not be interpreted as evidence that the work was commissioned by or delivered to the organisation, business or brand depicted unless explicitly stated otherwise.

2.3 RECREATED OR EXPLORATORY PROJECTS

Some projects may be created as recreations, redesign exercises, technical experiments, visual studies or explorations inspired by publicly observable design patterns, references or existing examples.

These projects are intended to demonstrate creative or technical capability.

MAKE DESIRE does not represent a recreated or exploratory project as original client work merely because it appears in the portfolio.

Where appropriate, such work may be identified as a Concept Project or Experimental Project.

2.4 CREATIVE REFERENCES

Creative References are images, videos, designs, examples or other visual material used for inspiration, comparison, reference or demonstration.

A Creative Reference is not necessarily owned or created by MAKE DESIRE.

Where third-party material is used as a reference, it should not be interpreted as a claim that MAKE DESIRE owns the underlying material or that MAKE DESIRE created the original work.

3. INTELLECTUAL PROPERTY AND OWNERSHIP

The appearance of an image, video, design, logo, product, interface, photograph, illustration, animation, template or other creative asset on the website does not by itself establish ownership of that asset by MAKE DESIRE.

Ownership and intellectual-property rights remain with their respective owners unless those rights have been lawfully transferred, licensed or otherwise granted to MAKE DESIRE.

MAKE DESIRE does not intend this policy to transfer, waive or claim ownership of third-party intellectual property.

4. THIRD-PARTY ASSETS

Portfolio projects may contain third-party assets where those assets are used as references, demonstrations, placeholders, examples or components of an exploratory project.

Third-party assets may include photographs, videos, graphics, fonts, logos, product imagery, templates, code, interface elements or other creative material.

The use or display of a third-party asset does not mean that MAKE DESIRE claims ownership of that asset.

Where a third-party asset is identified as belonging to another party, MAKE DESIRE will make reasonable efforts to avoid representing it as original MAKE DESIRE work.

5. PUBLICLY AVAILABLE PROMPTS, TEMPLATES AND DEMONSTRATIONS

MAKE DESIRE may use publicly available prompts, templates, demonstrations, tutorials, references or technical examples as part of learning, experimentation or creative exploration.

The public availability of a prompt, template, demonstration or example does not automatically transfer ownership or usage rights for every image, video, logo, design, code component, model or other asset associated with it.

Where third-party rights apply, those rights remain with their respective owners.

MAKE DESIRE does not intend to represent publicly available third-party material as proprietary MAKE DESIRE material solely because it has been used as a reference or starting point for experimentation.

6. NO IMPLIED CLIENT RELATIONSHIP

The presence of a brand, product, business name, logo, location or other organisation-related material in a portfolio example does not automatically establish that MAKE DESIRE has worked with, been hired by, been endorsed by or is officially affiliated with that organisation.

Unless explicitly stated and supported by the relevant project information, portfolio examples should not be interpreted as client engagements.

7. PERFORMANCE CLAIMS AND PROJECT OUTCOMES

MAKE DESIRE will not knowingly represent hypothetical or concept projects as having achieved real business results.

Claims concerning traffic, conversions, revenue, rankings, engagement, sales, leads, return on investment or other performance outcomes should only be presented where there is a genuine basis for the claim.

Where no verified performance information exists, the portfolio should focus on the creative, strategic or technical aspects of the work rather than inventing measurable outcomes.

8. ATTRIBUTION AND SOURCE RECOGNITION

Where attribution or source recognition is appropriate and reasonably available, MAKE DESIRE may identify the relevant creator, platform, source or rights holder.

Attribution does not necessarily constitute permission or a licence, and the absence of attribution does not necessarily mean that MAKE DESIRE claims ownership.

Where a rights holder requests correction, attribution or removal of material, MAKE DESIRE may review the request and take appropriate action.

9. REQUESTS CONCERNING COPYRIGHT OR OTHER RIGHTS

If a rights holder believes that material displayed on makedesire.my infringes their copyright, trademark, publicity rights, privacy rights or other legal rights, they may contact MAKE DESIRE with relevant information about the material and the basis of their request.

MAKE DESIRE will review legitimate requests in good faith and may remove, replace, modify, attribute or otherwise address the relevant material where appropriate.

10. ACCURACY OF PORTFOLIO REPRESENTATION

MAKE DESIRE aims to keep portfolio descriptions accurate and avoid misleading representations concerning the origin, ownership, client relationship or results associated with displayed work.

Where a project is a concept, experiment, recreation or reference, it may be labelled accordingly.

Portfolio presentation may change over time as assets are replaced, rights are clarified, projects are updated or the website evolves.

11. REMOVAL AND REPLACEMENT

MAKE DESIRE may remove or replace portfolio material for reasons including, but not limited to:

— copyright or licensing concerns

— rights-holder requests

— outdated material

— inaccurate representation

— availability of better original material

— changes in project ownership

— changes in portfolio strategy

— technical or performance considerations

The removal of material does not constitute an admission of infringement or wrongdoing.

12. NO WAIVER OF THIRD-PARTY RIGHTS

Nothing in this policy is intended to waive, limit, transfer or override the intellectual-property or other legal rights of third parties.

This policy does not grant MAKE DESIRE permission to use third-party material where such permission is otherwise required.

13. INDEPENDENT INTERPRETATION

This policy describes the intended portfolio-representation practices of MAKE DESIRE.

It does not replace applicable copyright, trademark, privacy, contract or other laws, nor does it create rights that do not otherwise exist.

Where a specific legal issue arises, the relevant facts and applicable law will determine the appropriate course of action.
